This month's legal tip for February, 2010 is:

  • The Clarksville City Court does not have subject matter jurisdiction over juvenile traffic citations according to Tenn. Code Ann. sec. 37-1-146. If your minor son or daughter gets one of the "Red Light Camera" tickets and the ticket is sent to you because the car is registered in your name, you can challenge the ticket because the violation was the child's, not yours, and the court does not have the power to consider the juvenile's ticket. This doesn't mean the city cannot bring the ticket in the Montgomery County Juvenile Court.
